Why is an Uber Rideshare Accident Different?

When you drive for Uber using your personal vehicle, you are in one of three situations:

  • You are using your car for purely personal use, unrelated to Uber
  • You are transporting a customer
  • You are in-between trips, connected to the Uber application and available to pick up a new passenger

These three situations have different implications in regards to insurance, therefore, insurance companies treat them differently.

  1. You are using your car for purely personal use, unrelated to Uber.

This is when you are driving to your normal job, going out with your family, or even taking a friend to a particular location.

When you do this, you do not have the Uber application open on the phone or, if you do, you are not available to pick up a new passenger.

In this case your own Personal Auto Policy (PAP) is covering you in case of an accident.

  1. You are transporting an Uber passenger

Your own PAP is clear when it says you are excluded coverage if you are using your car as a taxi or any other commercial activity.

For this situation, Uber issues its own insurance policy.

Uber has its own commercial policy (BAP) with limits of $1 million for liability, and underinsured motorists.

Uber’s policy is primary on its own PAP, so it is first to pay if something happens while transporting an Uber client.

Recently, the California Insurance Regulatory Office determined that the policy offered by Uber meets the requirements of the State and is suitable for this type of service, so it is fully covered while you are transporting an Uber passenger from the pick-up spot until you reach their destination.

  1. You are in between trips, connected to the Uber application and available to pick up a new passenger

This is where things get complicated.

As we mentioned before, the PAP will not be of help if you have an accident in this situation.

You are not technically transporting a passenger, but you are definitely involved in the business of doing so, since you are logged into the Uber application and are actively searching for one.

The BAP offered by Uber only covers you during the transport of a client, not making it clear if they will cover the time between trips.

This means that, as soon as you connect to your application and it becomes available, you are being excluded by your own car policy and, at the same time, you are not necessarily covered by Uber.

This is known as an insurance shortfall.

For example, a Labor Commission in San Francisco, California, has ruled that Uber drivers are employed, rather than mere contractors.

According to the commission, Uber is involved in all aspects of the operation, reason to accredit them with the category of employees.

Uber, for its part, has always maintained that they are a software company that connects people in need of a service, with others that offer it.

But this adjustment would make Uber a transport company, with all the legal and cost implications that this implies; such as offering social security to their drivers and complying with the transportation regulations of each country.

Unsurprisingly, Uber is appealing the decision.

It is still too early to have a final verdict, but for Uber there is a lot at stake and could set an important precedent that would turn all the places where the company currently operates, forcing them to change their turn, comply with the transportation laws, providing social security to their drivers and, of course, increasing costs.
