As reliability and faith in computer technology moves into the driver’s seat, who is at fault if nobody is driving? Insurance and personal liability legislation are constantly being revised to account for advancements in artificial intelligence and machine learning to help determine culpability in personal injury lawsuits.

There are several kinds of automated driving systems now in operation across the U.S. and every state is responsible for drafting their own legislation. As of mid-2021, national legislation, like S.1885, that works to act as a baseline to influence state law around self-driving cars was still awaiting to be voted on. 

According to the National Highway Traffic Safety Administration (NHTSA), this technology will save lives as evidence grows to support a reduction in the frequency of car accidents. However, accidents still do happen when computers are at the wheel. Currently no type of self-driving car is fully automated, with every type of automated driving system requiring a human co-pilot to assist. The NHTSA expects full highway autopilot to be legal as early as 2025, and Avrek Law is busy keeping up with the research to defend any personal injury case that is the result of an accident involving self-driving cars.
